PROBATE
"Colby, E. F., File #913. Intestate. Died 19 Apr 1884 at his residence in Waldo Hills. Adm: Silas H. Elliott, 14 May 1884. Heirs: Mary M. Colby, Widow, 78, Waldo Hills, Marion Co.; Mrs. Frances F. Forward, dtr [wife of Blair Forward]. Wm. M. Ramsey was named executor in will, but declined - residing in Pendelton in Dec 1889."
BIOGRAPHICAL (From A History of the Silverton Country, pg 78):
"Elias F. Colby was born in Sullivan county, New Hampshire, in 1811. At Bristol, in the state of his nativity, in June 1841, he married Mary M. --------. The family arrived in Oregon, October 12, 1850. The donation claim was in section 28, 29, 32, and 33 in township seven south one west, on which he settled September 1, 1851. One account states that the Colby's came to Oregon with the Davenports, but this is erroneous, as they came the next year. Don. Cer. No. 541."
OBITUARY: 
Death of a Prominent Citizen. Hon. E. F. Colby, after a protracted and painful illness, departed this life at his home in the Waldo Hills, in this county, on the 30th Day of April, 1884, of consumption, superinduced by a bronchial infection from which he had suffered for several years.
Mr. Colby was born in Meriden, New Hampshire, on the 6th day of May, 1810, and was married to Miss Mary M. Edwards at Bristol, in the same state, on June 6th, 1841.
The subject of this sketch, with his family, crossed the plains to Oregon in 1850 and took up the donation land claim upon which he lived until the time of his death. He leaves his widow and an only daughter, the wife of Mr. Blair Forward, present sheriff of Marion County, as surviving members of his family.
Mr. Colby was a man of superior intelligence and was well versed in the history of his government and country. He was State Senator in the first Legislative assembly of this state in 1859, and was one of the capitol building commissioners who superintended the erection of our present State Capitol. In all his public acts he was fearless and outspoken in obedience to his convictions of duty, and was always regarded by his associates as a logical reasoner, a safe counselor, and a true and faithful friend. He was a devoted husband and father, and his death is lamented by all who new him.

Passed Away – On Tuesday Mr. E.F. Colby, an aged and highly respected citizen of Waldo Hills, gave up the ghost and passed into the realms of shade. He was 74 years of age and leaves a beloved consort and one daughter (Mrs. Blair Forward) to mourn his loss. He was buried yesterday on the homestead by his lamenting friends and relatives.
